These Terms of Use (“Terms”) govern your access to and use of the services provided under the name RootHosts (“we,” “us,” or “the Service”), including hosting services and IT support available through our website and client communication channels.

By purchasing or using our services, you (“Customer,” “you”) agree to these Terms, our Privacy Policy, and any applicable individual Service Agreements.

RootHosts operates as an independent IT service provider based in the European Union, offering services on a freelance basis and/or through civil contractual arrangements.

1. Eligibility and Account Responsibility

You must be at least 18 years old or have reached the age of majority under the laws of your jurisdiction to use our services.

You agree that:

  • All information you provide is accurate and up to date;
  • You are responsible for maintaining the confidentiality of your account credentials (we strongly recommend that you do not share your username and password with third parties whom you do not fully trust);
  • You are fully responsible for all activities conducted through your account;
  • You should notify us immediately if you become aware of any unauthorized access to your account.

We may suspend or terminate access to services in cases of abuse, fraud, or violation of these Terms.

2. Description of Services

RootHosts provides hosting and IT support services, including:

  • Shared hosting and VPS solutions;
  • Server administration and technical support;
  • Network and infrastructure support.

Services are provided on a best-effort basis. No specific uptime level is guaranteed unless explicitly stated in the applicable service plan, Service Agreement, or SLA.

We reserve the right to perform periodic maintenance on our infrastructure and equipment when necessary. We will make reasonable efforts to minimize service interruptions while maintaining and improving our infrastructure.

3. Acceptable Use

You agree to use the services only for lawful purposes.

The following activities are strictly prohibited:

  • Illegal activities or unlawful content;
  • Distribution of malware or malicious software;
  • Unauthorized access attempts or hacking activities;
  • DDoS attacks or network abuse;
  • Spam or bulk unsolicited communications;
  • Infringement of copyrights, trademarks, or other intellectual property rights.

Violations may result in immediate suspension or termination of services without refund.

4. Fees, Payments, and Trial Period

All fees are listed in Euros (€). Prices are transparently displayed on our website or agreed upon individually.

Payment Terms and Trial Period

Payment is required in advance for the selected service period unless otherwise agreed.

To help new customers evaluate our services, we may offer a 7-day free trial period.

During the trial period, customers may receive:

  • Full access to the selected service or hosting plan;
  • The ability to evaluate performance, speed, and functionality;
  • Access to a real-world service environment without long-term commitment.

The trial period:

  • Begins upon service activation;
  • Is generally available only once per new customer;
  • Allows customers to evaluate the service before long-term use.
Hosting Services

If a customer has prepaid for a hosting service (for example, a monthly, semi-annual, or annual plan) but decides not to continue using the service for personal or technical reasons, the customer may choose one of the following options:

  • Activation of a 7-day trial period in addition to the paid service period; or
  • A refund of the amount paid, provided that the service has not been substantially used and was primarily intended for evaluation purposes.

Refund requests must be submitted within 10 days of the payment date.

This provision applies only to hosting services.

IT Support Services

A 7-day evaluation period may also be available for IT support services.

If the same issue reoccurs during the active support period or was not resolved correctly, any reasonable follow-up work related to that specific issue will be performed without additional charges.

Additional Conditions

Services may renew according to the applicable service type.

Late payments may result in temporary suspension of services.

Prices may be updated with reasonable prior notice.

Available payment methods may vary depending on availability.

5. Payment Documentation

As an independent service provider, we issue a payment receipt and/or service confirmation document instead of a standard accounting invoice.

The document may include:

  • Description of the service provided;
  • Service period;
  • Amount paid;
  • Payment date;
  • Transaction reference number.

This document serves as proof of payment and service delivery.

6. Service Availability and Limitations

We make reasonable efforts to maintain high service availability and reliability.

However, temporary interruptions may occur due to maintenance, software updates, network issues, hardware failures, or actions of third-party providers.

Service Interruptions and Compensation
  • No compensation is provided for service interruptions lasting up to one (1) hour.
  • For interruptions exceeding one (1) hour caused directly by us or our primary infrastructure providers, customers may be eligible for compensation in the form of:
    • Service extension;
    • Credit toward future services; or
    • Partial refund, where appropriate.

The form and amount of compensation will be determined on a case-by-case basis.

Force Majeure

We are not responsible for interruptions or failures caused by events beyond our reasonable control, including natural disasters, widespread cyberattacks, governmental actions, power outages, or failures of third-party infrastructure providers.

Service Level Agreements (SLA)

Where required, a separate Service Level Agreement (SLA) may be agreed upon, defining specific service availability commitments and compensation terms.

7. Termination

You may terminate services at any time by contacting us.

We may suspend or terminate services if:

  • These Terms are violated;
  • Payment obligations are not fulfilled;
  • Abuse, fraud, or illegal activities are detected.

8. Changes to These Terms

We may update these Terms from time to time.

Continued use of the services after changes become effective constitutes acceptance of the updated Terms.

9. General Principle

These Terms are intended to establish a fair, transparent, and mutually beneficial relationship between both parties in accordance with applicable European Union laws and regulations.
