These Terms of Use (“Terms”) govern your access to and use of the services provided by RootHosts (“we,” “us,” or “our”), including web hosting, VPS plans, managed IT support, and related offerings accessible via roothosts.com and our client portals. By signing up for services, making a payment, or otherwise engaging with us, you (“you,” “your,” or “Customer”) agree to be bound by these Terms, our Privacy Policy, and any applicable civil contracts. If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that entity.
As a team of EU-based freelancers providing IT solutions, we operate under the laws of the European Union, including the Unfair Contract Terms Directive, the Consumer Rights Directive, and relevant national implementations. These Terms form a legally binding contract. If any provision is found unenforceable, the remainder remains in effect.

- Eligibility and Account Registration
You must be at least 18 years old or the age of majority in your jurisdiction to use our services. By registering, you represent that you are eligible and that all provided information is accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts for violations, fraud, or non-payment, with notice where practicable.

Services are provided on a best-efforts basis, with maximum uptime targeted but not guaranteed. We may perform maintenance with advance notice, minimizing disruption.
- Customer Obligations
You agree to:
- Use services only for lawful purposes, complying with applicable laws (e.g., no illegal content, spam, or hacking).
- Provide accurate information and promptly respond to support requests.
- Maintain backups of your data; while we perform daily backups, we are not liable for data loss.
- Pay fees on time and adhere to resource limits (e.g., no excessive CPU usage that impacts others).
Prohibited activities include: transmitting malware, engaging in DDoS attacks, or hosting infringing material. Violations may result in immediate suspension and termination without refund.
- Fees and Payment
Fees are listed in euros (€) including VAT. Prices are listed on our website; we do not charge hidden fees.
- Payment Methods: PayPal, credit/debit cards, cryptocurrency, Revolut, or bank transfer.
- Billing: Monthly in advance; auto-renewal unless canceled. Late payments incur a 1.5% monthly fee.
- 7-Day Trial: Available upon request via email; initial payment required for IT services to prevent abuse. No advance payment for hosting trials.
- Upgrades/Downgrades: Prorated; seamless without interruption.
All payments are non-refundable except as outlined in Section 10. We may adjust fees with 30 days’ notice.
- Intellectual Property
We retain ownership of our tools, software (e.g., custom monitoring scripts), and trademarks. You grant us a limited license to use your content solely to provide services (e.g., hosting your website files).
You represent that your content does not infringe third-party rights. We may remove infringing material without notice.
- Confidentiality and Data Protection
We treat your business information as confidential under our civil contracts. As detailed in our Privacy Policy, we process personal data in compliance with GDPR. You consent to our data practices therein. For hosted data, you remain the controller; we act as processor per your instructions.
- Warranties and Disclaimers
Services are provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We disclaim liability for interruptions due to force majeure (e.g., cyberattacks beyond our control) or third-party failures.
You use services at your own risk. For medical IT, we provide general support but not medical advice; consult licensed professionals.
- Limitation of Liability
To the fullest extent permitted by law, our total liability under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits, data loss, or business interruption.
This limitation applies even if advised of the possibility. EU consumer law protections remain unaffected for non-business users.
- Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of services, including violations of law or third-party rights. We will notify you of such claims and cooperate in defense.
- Termination and Refunds
- By You: Cancel anytime via email or client portal; services end at billing cycle close, with prorated refund if prepaid.
- By Us: For cause (e.g., non-payment after 7 days, violations), with notice. Repeated issues may lead to permanent ban.
- Refunds: Full refund during 7-day trial if unsatisfied (excluding domains/SSL). Post-trial, refunds only for undelivered services per contract. Processed within 14 days via original method.
Upon termination, we delete your data per Privacy Policy retention rules.
- Miscellaneous
- Entire Agreement: These Terms, Privacy Policy, and civil contracts constitute the full agreement.
- Severability: Invalid provisions do not affect others.
- Assignment: You may not assign without consent; we may assign to affiliates.
- Force Majeure: No liability for delays due to uncontrollable events.
- Third-Party Links: We are not responsible for external sites.
By using our services, you acknowledge reading and agreeing to these Terms.
